To bring an insurance bad faith case as a tort claim, Alaska law requires the insured to show that the insurance company owed a duty to the insured, the insurance company breached that duty, and the breach caused the insured damages. To bring an insurance bad faith case as a breach of contract claim, you must show that the insurance company breached a provision in the policy and you suffered damages as a result of that breach.
